Default Beatlefest Changes Name - Legal Proceedings Instituted

This may be news to some on this list -- Beatlefest is now officially called "The Fest for Beatles Fans" and is changing their name as of the upcoming Boston Show.

This info was reported on Abbeyrd's Beatles Page a few days ago, as well as in the latest issue of Beatlefan Magazine...and has been on the Beatlefest web page (sort of -- the info has, but not the reason for it) for a while too.

Anyway...

Apparently, Apple has instituted proceedings to stop Mark Lapidos from using the Beatlefest name and cancel the Beatlefest trademark.

VERY interesting -- wonder what this means to the rest of us who use "Beatles" in the names of our websites, now that they've apparently gone after a big fish like Mark...

Frankly, I think it stinks, too -- Mark has used the Beatlefest name for nearly THIRTY YEARS and they decide to go after him NOW? This is really nasty, but I guess Neil and his minions at Apple have to justify their jobs somehow...but it sure explains a lot about why the dealer room has been decimated and why he hasn't been able to show the films anymore...

I really don't understand what the world is coming to. Did you do a search on plaintiff name - Apple Corps? Apparently, they object to any use of the term "Beatle" by Big companies, although they only hold trademark rights on "The Beatles"... It makes me furious! They've sued Beatlemania and a tailor's shop (whose mark includes in parentheses the descriptive "Original Tailor to the Beatles")... all of the cases have either been terminated or suspended.

It is ridiculous--especially since The B****** was not a TM until 1995 appearantly.
Also it's like they don't have enough money/control for their satisfaction.

Something about rich people you need to learn--they NEVER have enough money or power.
What's next,if your birth name is say,George Harrison, Apple will hits you with a lawsuit.

I'm with you, Jerry...I realized that they can't come after me for calling my site "Rooftop Sessions," which doesn't have "the B Word" in it...though they can come after me, possibly, for the logo picture (a Photoshopped version of the rooftop pic, bluured, intentionally) and for saying I publish the "Finest in Beatles Related Fiction." So I could always remove the photo (which I'm not wedded to, though it makes an attractive logo) and say "The Finest in Fab Fiction" or "The Best in British Invasion Fiction" and people would know what I meant...but I wonder, would they come after my writers for using "The B Word" in their stories? Gimme a break.

And I TOTALLY agree with you about Mark -- after he's used the name for nearly 30 years, to come after his butt now is completely ridiculous...not to mention he HAS donated tons to charity, and he obviously has the approval of at least one Beatle's estate, because Yoko sends tons of stuff to be auctioned off for charity and receives donations from B-fest to the Spirit Foundation...not to mention the National Coalition to Stop Gun Violence...and other charities...

I swear, Neil and his cronies must really need to justify their jobs or something...and if they start coming after the small potatoes like us, well, it's not gonna make them look too good.

Another thought, btw...

WHY is "BEATLEfest" not okay, but "The Fest for BEATLES fans" fine? Any idea? Because if they object to the use of "the B word," then the second option is just as bad as the first, yes? Is it because the first usage is using "the B word" to create a whole new tradmark, while the second is not? I just don't get it.

Just another thing that makes you go "hmmm..."

Thank you for those views, Susan. Now it's my turn.

I believe that by using the "B" word in personal sites should not have anything to worry about. We "little people" do not make any money for our sites. We have to pay to have some of these sites up.

Mark has been running Beatlefest since 1974. To attack him now for using "Beatle" in his company and website is totally ludicrous. The whole idea was to get as many Beatles fans together for a weekend to reminisce of what the Beatles did. Not being able to show their movies takes away a lot of the fun for many fans.

If Yoko can "endorse" what Mark does every year, then I don't understand why Neil/Apple would even think of stepping in here. If this trend is allowed to continue, then it's possible that just using the "B" word in simple conversation would have you digging in your pockets to be allowed to use it.

I'm through with the soap box now, so the next orater can voice their opinion.

I recall once in an interview when they asked George about the Beatlefest. He said, "If they can make a living off it, God bless them."

Of course, typical Pisces, another time he said kind of the opposite...hehehe

But, yeah, they should leave Mark alone...

I dont know. It's quite ridiculous if you ask me, on how they can crack down on people who are just trying to keep the music alive. It's rubbish! (&lt;---always wanted to use that word! )

That's exactly what I was wondering while I was reading the posts. I mean, what's the difference? You know, "The Fest For Beatles Fans" is okay, but "Beatlefest" is much more catchy (and easier to say). Personally, I'm going to still call it Beatlefest, and I know I won't be the only one. This whole thing is completely stupid.

I'm just vaguely worried that it's step one in shutting the whole operation down.

And am I the only one who is reminded of "The Artist formerly known as Prince" when I hear the phrase "The Fest for Beatles fans"? Stupid.

Seems odd too that they can still use "Beatlefest" as the address of their website and refer to "Beatlefest" all over their website, but yet have to call the actual Fest something else. Weird.

Just more evidence that the world is MUCH too litigious a place these days.

Actually, they're gradually shutting down the "Beatlefest" website and you soon won't be able to access it unless you go to "thefestforbeatlesfans.com". Go figure.

I don't know if they can make people shut their conventions down, but they can control what they call them. I mean, that convention in Cleveland is called "Abbey Road on the River," and it doesn't use the "B" word anywhere in its title...I think things like that will be okay.

But it is VERY disturbing that they are doing this after so many years...and yes, Rell, one of my friends is actually CALLING it "the convention formerly known as Beatlefest!"

You all are right on this. I like the analogy Rell drew with the "Artist Formerly Known as Prince." The whole thing seems really stupid to me.

If they can't use "Beatle" in their name, how about Moptop Meeting or Fab 4 Fest or someething of that caliber? I don't know, but this seems to be a frivolous lawsuit to me.

I read on the web site that 10/18/02 is the day the website changes to the new name.
