Lennon's killer denied parole again
Wednesday, October 9, 2002 Posted: 2:25 PM EDT (1825 GMT)

http://www.cnn.com/2002/LAW/10/09/ch...ole/index.html

NEW YORK (CNN) -- John Lennon's killer has been denied parole a second time, the New York State Division of Parole announced Wednesday.

The parole board announced its decision on M*** D**** C******'s parole request after meeting Tuesday. C****** can make another request for parole in October 2004, said Tom Grant, a spokesman for the parole division.

Transcripts of the parole board meeting were not immediately available.

C****** was previously denied parole October 3, 2000, by the board. C****** is serving his sentence at Attica state prison in western New York.

C******, 47, is serving 20 years to life after pleading guilty to shooting the former Beatle outside Lennon's Manhattan apartment in December 1980.

Under New York state law, C****** became eligible for parole once he had served 20 years.

In a July 2000 interview with Court TV, C****** said "I think the depression is over. The mental illness is over."

Since the shooting, Lennon's widow, Yoko Ono, has become an advocate against gun violence.

For the October 2000 parole hearing, Ono wrote a letter that reportedly opposed granting parole because of concerns over her safety and the safety of Lennon's two sons.

And from WINS (this is a local story here, after all):

John Lennon's Killer Denied Parole Again

Oct 9, 2002 11:05 am US/Eastern
(1010 WINS)-(Albany) -- No parole for John Lennon's killer.

That's the ruling after M*** D**** C******'s second appearance before the New York State Parole Board. The board denied him parole when he made his first appearance two years ago this month.

The 47-year-old C****** is serving a 20-years-to-life sentence for gunning down the former Beatle in Manhattan in December 1980.

While the parole board said C******'s behavior in prison continues to be "very positive," the panel said releasing him would "deprecate" the seriousness of his actions.

Lennon was slain outside his apartment in the Dakota building while returning from a late-night recording session with his wife, Yoko Ono.

At his parole hearing two years ago, C****** said he deserved to be in prison.

He's serving his sentence at Attica state prison in western New York.

And a later version of the story from the Associated Press:

Lennon's Killer Denied Parole Again

By MICHAEL GORMLEY
Associated Press Writer

ALBANY, N.Y. (AP) -- John Lennon's killer was denied parole for a second time, state officials said Wednesday on what would have been the slain Beatle's birthday.

Releasing M*** D**** C****** after 22 years in prison would "deprecate the seriousness" of the crime, the parole board said in a statement released Wednesday morning. The board said C****** had "acceptable" behavior in prison but that didn't guarantee he wouldn't pose a threat to society.

State Parole Division spokesman Thomas Grant. He said the timing of the notice and what would have been Lennon's 62nd birthday wasn't intentional.

At his first parole hearing two years ago, C****** said he did not deserve to go free. He will be up for parole again in 2004.

C******, 47, is serving 20 years to life for shooting Lennon outside his Manhattan apartment in 1980 as the former Beatle returned from a late-night recording session.

Transcripts of the latest hearing were not immediately available. At his parole hearing two years ago, C****** said: "I believe once you take a person's life, there's no way you can make up for that. Period."

C****** lives in a housing unit separate from the general population for his own safety and works as a clerk in prison, said James Flateau, spokesman for the state Department of Correctional Services. He was involved in three "minor incidents" between 1989 and 1994 for delaying an inmate count and refusing to follow an order, but nothing since 1994, Flateau said.

Lennon's widow, Yoko Ono, did not immediately respond to a request for comment left at her New York office. She had opposed C******'s parole two years ago, saying she was concerned for the safety of herself and her children.

If he wants to live he'd better stay in jail.I'm sure there is alot people who would love to take him out as soon as he stepped out of jail.

I said it before, I'll say it again - he's safer inside that cage. If one day he ever happens to walk outside, someone might have him killed.

I'll say this yet again...

He doesn't "get put up for parole." His sentence, under the laws that were in place in New York State in 1980, when he committed his crime, was "twenty years to life." Which means, under that statute, he is ENTITLED to a PAROLE HEARING every two years now that he's served his minimum of 20. This DOES NOT MEAN he will ever get parole. But, as much as we don't like it, that is his right under the law.

In New York State, as in all states of the U.S., the sentence for a crime depends on what is on the books in that state at the time the crime is committed. Since 1980, New York has enacted laws that include the death penalty for crimes such as his, or at the very least, life without parole. But as HE COMMITTED HIS CRIME BEFORE THESE LAWS WERE ON THE BOOKS in the state, his sentence is subject to the laws that were in place in 1980.

It's not a CHOICE to give him a parole hearing, it's the prisoner's RIGHT, whether we like it or not. However, it is fairly obvious that he won't ever get out, "model prisoner" or no...I don't think the NY State Parole Board is that stupid, and frankly, his life would be in danger if they let him out -- I don't think they want even the blood of this creep on their hands!

It's really too bad NY didn't have the death penalty back then. Instead of going straight to hell, he's living it here on earth. I dunno which is worse, but he deserves it! I know I would have felt better if he had been fried for what he did. And I'm usually a peaceful, non-violent person. And yes, I know killing "the jerk" won't bring back John. But he killed John and deserves the harshest punishment possible. *SIGH*.. I guess I can take comfort in knowing that he's hated by all walks of life, and I'm sure "the jerk" knows it.

Yeah,

I mean the guy has to know he's hated. He probably gets mail, and people probably still take the mickey out on him for it. Besides, I feel he deserves to live every miserable day of his life in that hell hole, knowing he is hated. Cuz the day he ever sits foot out of there...it will be over for him, and I think he knows that too.

If I knew everyone (the world, I mean) hated me, I'd probably end it all myself. Of course, I have a conscious.

What a great birthday present for John! At least two more years of his family's safety. Thanks for posting, Susan...I had no idea the trial was so soon. Didn't think he'd of gotten out, though.

Sounds like the NY Parole Board knows what to do!

I can't wish anything bad upon him even as much as that was probably the most traumatic night of my life, but I do fear that if he's let out, the violence could continue. I pray that he remains where he is so the chain does not continue.

Thanks for keep us updated!
