On 4 Jan '76, his depression had deepened to such a state that he took a .30 caliber lever-action rifle and chased Frances Hughes out of the house they were living in.
Frances was terrified because Mal had retreated to the upstairs bedroom with Frances' 4 yr old daughter, still holding the rifle. She called the cops and reported that Mal had flipped after taking too many pills.
The cops arrived ready for the worst, and demanded Mal come out unarmed. He told them they'd have to "blow (his) head off"... and they stormed the bedroom, only to find Mal lying across the bed with his rifle. He responded to their demand that he drop the weapon by aiming it at them...
The autopsy indicated Mal was neither drunk nor was he under any but a therapeutical dosage of Valium... there goes Frances' theory that Mal had flipped on pills. However, the rifle was loaded with live rounds, and one was in the firing chamber.
It appears Mal wanted to commit suicide, but he simply could not ... and forced the police to do it for him.
It's all very sad.
