I decided to give this its own topic, so that this great news doesn't get buried!

Yoko won the lawsuit against Fred Seaman!

Yoko Ono Gets Court Victory

Associated Press Writer


NEW YORK (AP) In a legal victory for Yoko Ono, a judge has decided a former personal assistant who wrote a tell-all book about John Lennon was bound by a confidentiality agreement, lawyers said Thursday.

The ruling against Frederic Seaman ``will prevent him from future exploitation of the Lennon family,'' said Ono's lawyer, Paul LiCalsi.

U.S. District Judge Leonard Sand made the ruling in chambers on the eve of closing arguments in a trial stemming from Ono's 1999 lawsuit against Seaman, lawyers from both sides said outside court.

The judge found that Seaman signed a valid, binding confidentiality agreement when he was hired in 1979, LiCalsi said.

``We respectfully disagree with the judge's decision,'' said Seaman's attorney, Glenn Wolther. ``We believe it violates Mr. Seaman's right to free speech.''

In her lawsuit, Ono alleged Seaman violated the confidentiality agreement by publishing a memoir titled ``The Last Days of John Lennon: A Personal Memoir.'' She also claims he profited by stealing mementos of the late ex-Beatle and selling them to collectors.

The suit demands that Seaman surrender the rights to 374 photos he took of the Lennon family, turn over about $75,000 from the sale of the rock icon's papers and pay unspecified damages.

Seaman contends he is the rightful owner of the photos because he took them on his own time and with his own camera.

Ono and Seaman have feuded since Lennon's 1980 slaying outside his Central Park West apartment building.

In 1983, Seaman pleaded guilty to second-degree larceny for stealing Lennon's diaries; he was sentenced to five years probation and ordered to return the property. Seaman said he has returned all the items; Ono said he returned only some of them.

On the final day of testimony Thursday, Ono laid claim to a family photo at the center of the dispute with her former assistant.

The photo of Lennon with their son, Sean, at a Bermuda beach in 1980, showed ``John was a person,'' Ono told jurors. ``He was not just an artist, but a family man and a dad.''

(1010 WINS)-(NEW YORK)- A settlement was reached Friday between Yoko Ono and a former employee over his use of hundreds of private family photos, ending a dispute that stretched across two decades.

As part of the settlement, former assistant Frederick Seaman issued a public apology to Ono, her late husband John Lennon and their son Sean, lawyers for both sides announced.

"I offer no excuses for my conduct, and ask only that you can find it in your heart to forgive me," Seaman said in a statement read in court by Ono's attorney.

Ono had sued him over the rights to 374 photos he took of the Lennon family, many in the months before her husband's slaying. The settlement was a complete victory for Ono, forcing him to surrender all rights to the photos.

Seaman must also return any Lennon-related items still in his possession within 10 days, and has admitted that had exploited the Lennon legacy for personal profit.

"After more than 20 years, it's time to ask for forgiveness for my actions," Seaman said. "I now realize how much pain and embarrassment I have caused."

The trial had opened Monday, more than two decades after Lennon was murdered by a deranged fan as Ono watched in horror. Closing arguments were supposed to have begun Friday morning.

Seaman's defense received a devastating blow on Thursday when U.S. District Court Judge Leonard Sand ruled there was overwhelming evidence that a confidentiality agreement signed by Seaman when he was hired in 1979 was valid and binding.

Negotiations aimed at settling the dispute began Thursday in Sand's chambers.

In her lawsuit, Ono alleged that Seaman violated the agreemen t by publishing a memoir titled "The Last Days of John Lennon: A Personal Memoir." She also claimed he profited by stealing Lennon mementos and selling them to collectors.

The suit demanded that Seaman surrender the rights to 374 photos he took of the Lennon family, turn over about $75,000 from the sale of the rock icon's papers and pay unspecified damages.

I think its very sad, actually, for Sean. I read an article just now where he says he saw a certain video for the first time, of him and his dad. He also says that a lot of his memories of his father are fading, because he was only five years old when he died. Its amazing that he has memories at all. I'm a bit younger than Sean and can honestly tell you very few distinct memories from my childhood. They are there vaguely.

It must say something about how much time John did spend with his son that Sean can still hold on to those few memories all this time. Its sort of a bittersweet victory, really. But, then again, wouldn't anything be for that family after 1980?

(1010 WINS)-NEW YORK -- The text of Frederic Seaman's apology to Yoko Ono:

"I wish to offer this public apology to Yoko Ono. I did wrong by you and indeed am guilty of violating your trust. After more than 20 years, it is time for me to ask for your forgiveness for my actions.

"I did in fact steal items from you that once belonged to you and John. These items include diaries, documents and more. I wrote things about you and your family in my book and various tabloids that were factually inaccurate, and I now realize how much pain and embarrassment I have caused. It is impossible to undo what has taken place. But it stops here and now.

"I will return any remaining things that I have that are yours. I will refrain from ever writing anything about your family or about the time in your employ. I offer no excuse for my conduct and only ask that you can find it in your heart to forgive so I can move on with my life."

Y'know, reading that "apology" really irritated me. Everyone makes mistakes in their life, but I have a lot more respect for somebody who says "Oops, I screwed up, I own up to it and accept the consequences" than someone who forces the whole thing to go to litigation, lies, saying they haven't done anything wrong, is found guilty and THEN admits "Uh...yeah...I did do it after all..." God, I know EXACTLY what you mean...after all the crap, after forcing Yoko to drag him to court, after denials and what have you...he's such slime! Just turns my stomach...I think he deserves worse than he got, frankly, for putting Yoko and Sean through further emotional pain and suffering!

You know what particular image of this schmuck's wrongdoing REALLY bugged me? The fact that he stole John's CLOTHES when the man was barely cold! Something about that...I mean, clothing is such a personal thing, and for him to (a) steal it, and (b) turn up WEARING it in front of Yoko when she didn't GIVE it to him...can you imagine? I'm glad he was found guilty, I'm just sorry the sentence wasn't a bit more painful for him.
